These Terms and Conditions (the "Terms") form a binding agreement between you ("you", "your") and PlateLogic ("PlateLogic", "we", "us", "our") and govern your access to and use of the PlateLogic mobile application and any related services (collectively, the "Service").
By downloading, installing, or using the Service you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.
The Service is intended for users who are 18 years of age or older. By using the Service you represent that you meet this age requirement and that you have the legal capacity to enter into a binding agreement in your jurisdiction. We do not knowingly provide the Service to individuals below this age.
PlateLogic is a calorie- and activity-tracking application. It allows you to log meals and activities, view nutritional information, set goals, and access optional AI-assisted features that estimate the nutritional content of foods from images or text descriptions.
The Service is provided "as is" and may evolve over time. We may add, modify, or remove features at our discretion. Some features are available only to subscribers (see Section 6).
Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to download and use the App on a device that you own or control, solely for your personal, non-commercial use.
You may not:
When you start the App we automatically create an anonymous account that is identified by a randomly generated identifier. We do not ask you for a name, email address, or password to use the Service. You are responsible for keeping your device secure and for all activity that occurs through your installation of the App.
You may delete your account at any time from within the App (Settings โ Delete account). Deleting your account removes your anonymous identifier and the associated data we hold; see our Privacy Policy for full details.
Basic features of the Service are available free of charge. A paid subscription (the "Pro" tier) unlocks additional features, including unlimited food search and unlimited plate scans, subject to the Fair Use Policy in Section 7.
Subscriptions are sold and managed by Apple's App Store or Google Play, depending on your platform. Payment will be charged to your store account when you confirm the purchase. Subscriptions automatically renew at the end of each billing period unless you cancel before the renewal date. You can manage and cancel your subscription at any time in your device's store account settings.
We may from time to time offer free trials or introductory pricing. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the then-current price. Trial availability and terms are determined by the app stores and by us at our discretion.
We reserve the right to change the price of any subscription at any time. Pricing changes will not affect a billing period that is already paid for. For subsequent renewals we, or the relevant app store on our behalf, will notify you in advance of any price change and will obtain your consent where required by applicable law or app-store policy. If you do not accept a price change you may cancel your subscription before it takes effect.
Because subscriptions are billed by the app stores, refunds are governed by the refund policies of Apple and Google. To request a refund please contact the relevant store directly. Statutory rights to withdraw from a purchase under applicable consumer-protection law (for example, the EU 14-day right of withdrawal) are unaffected by this section.
Prices may include or exclude applicable taxes depending on your location and the rules of the app store processing your purchase. The store at checkout will display the final amount you will be charged.
The Pro tier is marketed as offering unlimited use of food search and plate scan features. To keep the Service reliable and affordable for all users, "unlimited" is subject to this Fair Use Policy.
"Fair use" means use that is consistent with what a typical individual user would reasonably perform for personal nutrition tracking on a daily basis. This includes logging meals, snacks, and beverages as you consume them; scanning plates at meal times; and looking up foods you are about to eat.
The following activities are considered outside fair use:
Where we detect activity that exceeds fair use, we may, at our discretion and proportionate to the issue:
We will apply this policy reasonably and only to the extent necessary to protect the Service. The vast majority of paying users will never encounter a fair-use limit.
The Service uses artificial intelligence to estimate the nutritional content of foods from images or text you submit. AI outputs are estimates only and may be inaccurate, incomplete, or inconsistent. You are responsible for reviewing and, where necessary, correcting any AI-generated values before relying on them.
Submissions to AI features are processed by our AI service provider, which may operate outside your country of residence. See our Privacy Policy for details on data transfers and the safeguards we apply.
Always consult a qualified healthcare provider before making significant changes to your diet, exercise routine, or lifestyle, especially if you have a medical condition, are pregnant or nursing, are taking medication, or have a history of eating disorders. Do not disregard professional medical advice or delay seeking it because of something you read or saw in the Service.
You agree not to use the Service to:
The Service, including its software, design, text, graphics, logos, and the PlateLogic name and marks, is owned by us or our licensors and is protected by intellectual-property laws. Except for the limited license granted in Section 4, these Terms do not transfer any intellectual-property rights to you.
Open-source components included in the App are licensed under their respective licences, which prevail over these Terms for those components.
You retain all rights to the meal, activity, weight, and other content you create and store in the App ("Your Content"). Your Content is stored on your device and, where you choose to use AI features, sent to our AI provider for processing as described in our Privacy Policy.
You grant us a worldwide, non-exclusive, royalty-free licence to use Your Content solely as necessary to provide the Service to you (for example, returning a nutrition estimate based on an image you submit). We do not use Your Content to train AI models, sell it, or share it with advertisers.
The Service relies on third-party providers โ including app-distribution platforms, cloud infrastructure, the subscription manager, and the AI service provider. Your use of those third-party services is governed by their own terms and privacy policies. We are not responsible for the acts or omissions of third parties.
Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect information in connection with the Service and forms part of these Terms.
You may stop using the Service at any time. You may delete your account from within the App, which removes your anonymous identifier and associated data as described in the Privacy Policy.
Please note that deleting your account or uninstalling the App does not automatically cancel an active paid subscription. Subscriptions must be managed and cancelled through your Apple ID or Google Play account settings.
We may suspend or terminate your access to the Service, with or without notice, if you breach these Terms (including the Fair Use Policy), if required by law or by an app store, or to protect the security and integrity of the Service. On termination, the licence granted in Section 4 ends and you must stop using the Service. Sections that by their nature should survive (including IP, disclaimers, liability, indemnity, and dispute resolution) will continue to apply.
To the maximum extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, or uninterrupted operation. We do not warrant that the Service will be error-free, that AI outputs will be accurate, or that the Service will meet your specific requirements.
Some jurisdictions do not allow the exclusion of certain warranties; in those jurisdictions, the exclusions above apply only to the extent permitted by law, and you may have additional statutory rights.
To the maximum extent permitted by law, in no event will PlateLogic, its developer, affiliates, licensors, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of, or inability to use, the Service.
To the extent that any liability cannot be excluded, our total aggregate liability arising out of or relating to these Terms or the Service is limited to the greater of (a) the amount you paid us for the Service in the twelve (12) months preceding the event giving rise to the liability, or (b) ten US dollars (USD 10).
Nothing in these Terms limits or excludes liability that cannot be lawfully limited or excluded, including for death or personal injury caused by negligence, fraud, or any other liability that applicable law does not permit to be limited.
You agree to defend, indemnify, and hold harmless PlateLogic and its developer from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any applicable law or third-party right.
If you downloaded the App from the Apple App Store, the following also apply:
If you downloaded the App from Google Play, your use of the App is also subject to the Google Play Terms of Service. As between PlateLogic and Google, PlateLogic is solely responsible for the App.
These Terms are governed by the laws of the jurisdiction in which the developer of the Service is established, without regard to conflict-of-law principles. Mandatory consumer-protection laws of your place of residence remain unaffected.
Before initiating a formal dispute, you agree to contact us at wasim.codeartist.business@gmail.com and use reasonable efforts to resolve the matter informally. If we cannot resolve the dispute within 30 days, either party may pursue formal proceedings.
EU consumers may, in addition, use the European Commission's online dispute-resolution platform at ec.europa.eu/consumers/odr.
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where the changes are significant, provide a prominent notice within the App. Your continued use of the Service after the updated Terms take effect constitutes acceptance of those changes. If you do not agree with the updated Terms, you must stop using the Service.
Entire agreement. These Terms and the Privacy Policy constitute the entire agreement between you and us regarding the Service and supersede any prior agreements on the same subject matter.
Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
No waiver. Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
Assignment. You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms to a successor in connection with a merger, acquisition, or sale of assets.
Force majeure. We are not liable for any failure or delay in performance to the extent caused by events beyond our reasonable control, including outages of third-party providers, internet disruptions, or natural events.
No agency. Nothing in these Terms creates an agency, partnership, joint venture, or employment relationship between you and us.
